Chiara Muston is a dual-qualified solicitor in Italy and England and specialises in employment law. She advises on domestic and cross-border matters concerning all aspects of employment relationships and industrial relations, both contentious and transactional.

Chiara assists senior executives and companies of all sizes negotiate and draft employment contracts and service agreements (including for businesses subject to the SMCR), incentive plans, consultancy agreements, and employee handbooks and policies. She also has experience in managing and terminating employment relationships, dealing with complex grievance and disciplinary procedures, as well as, long-term sickness absences, discrimination and whistleblowing cases. She regularly negotiates  settlement agreements with senior managers and executive directors.

 She regularly advises employers in the framework of collective and individual consultations and negotiations with employees and trade unions representatives, as required in situations such as transfer of undertaking and redundancies (individual and collective).

Chiara has particular expertise advising companies in the leisure, retail, hospitality, automotive, telecommunications and gig economy sectors. She has been involved in their setting up, management, expansion, re-organisation and winding up phases. She supports clients with strategic business decisions, such as implementing the government's furlough scheme (CJRS) and planning the return to work of staff, addressing health and safety, as well as, data protection issues.

She regularly represents clients in court on matters involving unfair and wrongful dismissals, claims of discrimination and victimisation, and violation of collective redundancy procedures.

  • Representing a company in the gambling sector in a dispute brought against it by a number of employee representatives claiming a breach of the collective redundancy consultation process.
  • Advising an AIM listed company in its relaunch and negotiating the service agreements of its executive directors and senior managers.
  • Advising clients in the hospitality sector on the implementation of the Coronavirus Job Retention Scheme (CJRS) and compliance with Government guidance on working safely during the COVID-19 pandemic.
  • Advising a company in the gambling sector on the disciplinary procedure and subsequent dismissal for gross misconduct of its CEO.
  • Representing a distribution company in the food and beverage sector in a dispute against one of its former commercial agents for the breach of post-termination restrictions.
