We have significant experience within the financial services sector, and are particularly recommended for our work in contentious matters, including defending bonus and incentive claims, defending whistleblowing and discrimination claims, High Court injunctions and team moves. We can provide in-house training and regular email updates on these rapidly developing areas of law.

On the non-contentious side, we have notable expertise in drafting and advising on post-termination restrictions, complex incentive arrangements and compensation arrangements, including the impact of the FCA's Remuneration Code and likely impact of the AIFM Remuneration Code from both the employer and the executive's perspective.

Examples of our work include:

  • defending a private equity house and one of its management team against whistleblowing allegations by an LLP member: achieving a commercial settlement which preserved our clients’ reputations
  • defending a hedge fund against claims of sex discrimination and victimisation, successfully settling for a fraction of the sums claimed
  • acting for a broking house in enforcing garden leave and post-termination restrictions against a team of brokers and their putative new employer. Our litigation tactics ensured that undertakings for compliance with garden leave and restrictions were secured, so protecting the business
  • providing strategic advice on the conversion of an unlimited partnership to an LLP in order to ensure compliance with the AIFMD
  • advising and overseeing the employment aspects of an in-depth internal investigation, carried out in conjunction with our Investigations, Enforcement and Financial Crime team, which successfully mitigated the litigation and regulatory risks faced by an investment management company
  • advising on claims and strategy in relation to a dispute involving race discrimination and alleged breaches of an LLP Agreement. We successfully concluded an agreement which enabled our client to remain in the partnership with his position protected and an enhanced profit share.
