Shreena Avery is a solicitor acting for developers, funders and landowners on commercial development transactions, including sale contracts and landlord and tenant matters.

Shreena acts for a wide range of developers and landowners (both property companies and individuals) on the acquisition, sale, development and financing of commercial and mixed-use schemes. Her experience covers the office, residential, student accommodation, and retail sectors. She has a particular focus on airspace and rooftop developments, as well as, PRS and Build to Rent.

She also acts for funders who are financing the acquisition and development of sites by developers, and through working together with her colleagues in the Banking, Planning and Construction teams, she is able to provide a full and seamless service to clients. 

Shreena advises clients on rooftop developments and on the best way to structure these transactions, from both a commercial and legal perspective. Rooftop schemes can be complex and many factors need to be taken into account, such as rights of first refusal for existing flat owners. Shreena's experience in this field means she offers practical and commercial solutions to her clients on matters which are often complex and time-sensitive, and which her clients may not have already considered.

Complementing her development expertise, Shreena advises on option agreements and overage agreements, as well as, negotiating joint venture agreements, which are commonly used by developers and landowners on rooftop schemes, as an alternative to airspace leases.

For property investors, Shreena advises on their property requirements and on going property portfolio management, as well as, their general business occupation, and landlord and tenant matters.  

Recent work
  • Advising a landowner of a block of flats comprising circa 80 units on the grant of an airspace lease to a developer, including advice on overage provisions, negotiating an option agreement and advising on Section 5 notices (Landlord and Tenant Act 1987).
  • Advising a landowner on an alternative structure for airspace development where granting a lease was not a possibility (due to various complex title arrangements in place).
  • Advising a developer on the grant of an airspace lease and in respect of rights of access and running of services under adjoining land to enable the development to take place.
  • Acquiring a portfolio of 20 HMO properties for approximately £13m.
  • Advising a landowner/developer on the grant of a lease for use as student accommodation in a major UK city and negotiating complex lease and agreement for lease provisions with planning conditions, valued in excess of £45m. 
  • Re-financing a portfolio of five warehouse units, including the negotiation of the CLLS Certificates of Title with a total value of £10m.
  • Advising a property company on a complex title structure involving four leasehold residential blocks and commercial units.
  • Advising a lender client on complex development issues arising in relation to planning, overage and development agreements, with loan sizes ranging from £2m - £25m.
