Robert Adjetey is a construction disputes specialist with over 15 years’ experience advising on high-value, complex dispute resolution matters across the built environment sector.

Robert is a Legal Director in the Construction Disputes Team at Howard Kennedy. He provides commercially focused and strategic advice to developers, housebuilders, contractors and construction industry participants on risk throughout the lifecycle of projects, from contract procurement and live project advisory work, through to dispute avoidance and resolution following completion.

He has extensive experience in complex dispute resolution, including adjudication, litigation, mediation and direct negotiation. Robert has successfully acted in proceedings before the Technology and Construction Court, the Court of Appeal and the Supreme Court, and is particularly experienced in managing large-scale disputes involving technical, legal and commercial complexities. He is equally adept at delivering strategic advice behind the scenes as he is in leading matters through formal dispute processes.

Robert has significant recent experience advising major UK housebuilders on fire safety and building safety issues, including claims arising under the Building Safety Act 2022 and the Defective Premises Act 1972. His work has involved advising on large portfolios of claims, coordinating remediation strategies, managing stakeholder relationships, and providing risk advice at both asset portfolio and individual development level. He has also played a leading role in high-profile litigation in the Supreme Court concerning novel building safety issues.

In addition to his disputes practice, Robert advises clients on day-to-day project risk management, including issues relating to delay, defects, payment and termination. He is experienced in working with standard form contracts including JCT and NEC, as well as bespoke agreements, and regularly collaborates with technical experts across a range of disciplines. He has extensive experience of helping clients to manage disputes as they arise on live projects, helping to mitigate delays and losses, and maximise recoveries.

Robert provides clear, commercially-focussed advice to clients, helping them to make decisions which lead to valuable and successful outcomes.

Recent work

    • Acting for a leading UK housebuilder in a landmark Supreme Court appeal concerning novel issues under the Building Safety Act 2022, forming part of a wider portfolio of professional negligence claims.
    • Advising a major PLC housebuilder on a substantial portfolio of claims against its structural engineer concerning alleged design defects across multiple residential and mixed-use developments throughout the UK.
    • Providing strategic advice to a number of PLC housebuilders in relation to fire safety risks, including claims under the Building Safety Act 2022 and the Defective Premises Act 1972, and coordinating remediation and stakeholder engagement strategies.
    • Acting for a major UK housebuilder in adjudication proceedings concerning a £17.5m façade package, successfully reducing a loss and expense claim from approximately £2m to c. £450,000.
    • Defending a UK developer in Technology & Construction Court proceedings relating to alleged defects in M&E works, including contribution claims against contractors and expert-led technical issues.
    • Acting for a developer in adjudication proceedings concerning a £9m infrastructure package, successfully limiting the contractor’s recovery to a fraction of the sum claimed.
    • Successfully defending multiple adjudications brought by a groundworks contractor for alleged wrongful termination, defeating claims in excess of £200,000.
    • Advising clients across the construction sector on live project risk management, including issues relating to delay, defects, payment mechanisms and termination under JCT, NEC and bespoke contracts.
    • Acting for a top-tier UK contractor in a circa £100m Technology & Construction Court dispute concerning a major infrastructure project, including responsibility for large-scale disclosure, witness evidence and expert coordination.
