Kevin's expertise is divided into three main areas, white collar crime, competition law and financial services regulation.
In relation to white collar crime he has acted and advised in many of the major investigations and prosecutions conducted by the Serious Fraud Office (SFO) in the last 20 years including Hinchliffe/Fascia Group, Bae, Balfour Beattie, Mabey and Johnson, Alstom and others. He conducts internal investigations for corporate clients and in the last two years has conducted investigations in Nigeria, Angola, Egypt, Italy, Croatia and China.
In relation to corporate compliance, Kevin advises on and creates Bribery Act compliance programmes. He has advised and assisted over 100 businesses with their compliance, ranging from FTSE 100s to SMEs. Kevin was Chairman of the International Bar Association Working Group on the Bribery Act and wrote the IBA response to the Government proposals on Adequate Procedures.
In addition to his compliance expertise, Kevin undertakes due diligence in relation to M&A transactions, analysing and assessing the compliance risk posed by target companies in take-overs or acquisitions.
Kevin has acted in all but one of the UK's criminal cartel prosecutions, including acting for a senior British Airways (BA) executive in the prosecution of passenger ticket pricing agreements between BA and Virgin Atlantic, including acting in the parallel US investigation. In addition, Kevin has acted in civil cartel investigations including the bid rigging investigation into the UK construction industry which the Competition and Markets Authority (CMA) claim to be the largest anti-trust investigation ever undertaken by any competition regulator anywhere in the world.
In relation to Financial Services regulation, Kevin acts in both civil and criminal investigations. That includes advice in compelled interviews, advice in relation to negotiated penalties, investigations into Handbook breaches and breaches of Principles, permissions and approvals. He advises corporate clients in relation to the Senior managers Regime and market abuse. He also conducts appeals in the Upper Tribunal following Final Notices.
In relation to criminal investigations by the Financial Conduct Authority (FCA), Kevin has acted in a number of insider dealing prosecutions including the first ever cross border investigation concerning information from the US being used in the UK in respect of stocks traded in Germany.
Kevin lectures and writes on a variety of subjects related to his areas of expertise. He is listed as an expert in Chambers, Legal 500, International Who's Who of Business Crime Lawyers, The world's Leading White Collar Crime Lawyers and UK's Best Lawyers.
