Daniel Swimer:

Senior Associate

Daniel is a senior associate in the firm’s real estate dispute resolution department.

He advises on and resolves disputes, as well as litigating on contentious property matters. Daniel’s experience includes business lease renewals and terminations, advising on strategies for securing vacant possession on redevelopments, dilapidations, rent reviews, break notices, service charge disputes, arrears recovery, breaches of covenant, squatters and possession cases, leasehold enfranchisement and landlord and tenant insolvency.

Daniel has been involved in a mix of High Court and County Court litigation actions, in the First Tier Tribunal and also in mediations and arbitrations.

Daniel is a member of the Property Litigation Association.

Recent work

  • Advising a developer client on a strategy for the removal of numerous retail and leisure tenants from commercial premises
  • Advising and securing a substantial windfall for a tenant in an opposed lease renewal on redevelopment grounds
  • Advising a construction client against a claim for non-payment of substantial consultancy fees
  • Securing access and other rights for a student accommodation developer over neighbouring land in settlement of a long standing dispute
  • Advising a landlord of a large residential building in the successful recovery of service charge arrears
  • Acting in possession proceedings against an insolvent tenant and negotiating the recovery of a considerable debt from a former tenant following service of Section 17 Notices.
