About

Anette Bernerova is a dual-qualified Solicitor and Chartered Trade Mark Attorney, advising clients on all aspects of trade marks, designs, brand protection and commercial intellectual property matters.

Anette works with a broad range of clients, from innovative start-ups to major international corporations, particularly in the telecoms, media, technology, fashion, leisure and hospitality sectors. Her practice spans the full lifecycle of intellectual property rights, including brand creation and clearance, global portfolio management, trade mark and design prosecution, contentious proceedings, commercial transactions and strategic IP advisory work.

She has extensive experience managing international trade mark portfolios and coordinating multi-jurisdictional strategies through networks of foreign counsel. Anette regularly advises on complex UK and international trade mark and design matters, including opposition, cancellation and infringement proceedings, and has represented clients in matters before the UKIPO, EUIPO and the General Court of the European Union.

In addition to her brand protection practice, Anette advises on the intellectual property aspects of corporate and commercial transactions, including IP ownership, licensing, assignments, due diligence and the negotiation of a broad range of commercial agreements. She also advises on copyright, design rights and wider intellectual property issues.

Prior to joining Howard Kennedy, Anette held roles at leading international law firms including Dentons and CMS, and completed an in-house secondment with Sky's IP and Litigation team, where she advised business stakeholders on a wide range of intellectual property and media-related matters and supported the management of Sky's global trade mark portfolio.

Representative Experience

  • Long-term management of an international trade mark portfolio for a leading global telecommunications and connectivity business.
  • Advising on the intellectual property aspects of a major global technology acquisition by a UK governmental agency in connection with the introduction of polymer banknotes.
  • Advising on a landmark EU trade mark dispute culminating in a hearing before the General Court, resulting in a decision that had precedential significance for EUIPO practice (KID-SYSTEME GmbH v EUIPO (Case T-354/18)).
  • Associate in proceedings concerning a wide-ranging declaration of non-infringement relating to BSkyB's key trade marks in the field of public sector cloud computing, reported at [2017] FSR 6 (Skyscape Cloud Services Ltd v British Sky Broadcasting Group plc & ors).
  • Advising clients on international brand enforcement programmes, settlement negotiations and cross-border disputes involving coordinated action through local counsel.
