Alexandra Johnstone advises clients on intellectual property, data protection, and commercial issues, with a particular interest in the retail, tech, creative, media, and entertainment sectors.

Alex covers advisory, commercial and contentious intellectual property work for clients. She advises on all forms of registered and unregistered IP, with a particular focus on trade marks, copyright, design rights and domain names.

Her clients range from creative and high-profile individuals to global brands and businesses, helping them to both exploit and protect their valuable IP rights.

Alex implements client's objectives and strategies through drafting and negotiating a full set of commercial agreements.

These include influencer, endorsement, and sponsorship agreements, as well as, software, technology and IP licences and assignments. She also regularly assists clients with distribution, franchising and agency agreements, supply and consignment agreements, publishing agreements, confidentiality and non-disclosure agreements, as well as, consumer, website, and app related terms. 

She has deep knowledge of advertising rules in the evolving world of online and social media advertising, including responding to the Advertising Standards Authority on behalf of clients. 

Alex regularly advises on data protection and privacy issues, particularly in relation to customer personal data. 

This work includes assisting clients to develop and implement data governance frameworks, from the initial data mapping stage to drafting privacy notices and data processing agreements, as well as preparing for and responding to personal data breaches.

  • Acting for the owner of one of the 25 most well-known trade marks in multiple domain name disputes, and maintaining a 100% rate of success.
  • Acting on the acquisition of the IP in a £100m+ business operating across over 20 jurisdictions. 
  • Re-negotiated the key music and video supplier agreements which enabled HMV to keep running, avoid job losses, and be successfully sold.
  • Drafting and negotiating social media influencer and celebrity endorsement agreements for one of the most recognisable jewellery brands in the UK.
  • Acting for a client whose group's websites are in the top 50 most visited websites globally on their personal data issues.
