Naomi O'Higgins is an expert in trusts and estates disputes, as well as, Court of Protection work. Much of her caseload has an international element.

Naomi is a partner in the firm's leading Trusts and Estates Disputes practice. She supports clients across a range of trusts disputes including breach of trust claims and trustee/beneficiary disputes. She has particular experience of litigation with cross-border elements working with lawyers in offshore jurisdictions. She additionally advises on non-contentious trusts related applications.

Naomi also advises on inheritance disputes including challenges to the validity of wills, removal of executors, and claims under the Inheritance (Provision for Family and Dependants) Act 1975.

Naomi works with clients on Court of Protection matters such as statutory wills, disputes regarding the appointments or actions of attorneys, as well as, other cases concerning people lacking capacity to manage their own affairs.

She is a private client lawyer who specialises in litigation. This means that she has a practical and empathetic approach in advising clients facing difficult, often emotional, challenges.

Naomi often works alongside colleagues in the firm's Private Client and Family teams on complex multi-jurisdictional issues. She has litigated in a number of foreign/offshore jurisdictions including, the Channel Islands, the Cayman Islands, the Bahamas, and Switzerland and has excellent relationships with firms in those and the other major offshore jurisdictions.

Naomi and her colleagues in Howard Kennedy's Trusts and Estates Disputes practice are recognised as leading experts in their field and as such they are regular speakers at conferences both in London and abroad.

Naomi is a member of the Association of Contentious Trust and Probate Specialists (ACTAPS), the STEP Contentious Trusts and Estates and Mental Capacity Special Interest Groups, and the Law Society Probate Section. She is dual qualified having been admitted to the Roll of Solicitors in Ireland in 2017.

  • Running an application for the variation of family trusts holding significant assets which involved coordinating over 20 professional advisers.
  • Advising defendants in relation to a debt allegedly owed to the trustees of an offshore charitable trust.
  • Advising the litigation friend to a disabled adult child in connection with a claim under the Inheritance (Provision for Family and Dependants) Act 1975.
  • Advising on an application to the Court of Protection to enable the sale of shares held by an incapacitated adult.
  • Advising the father to a party to a divorce in connection with his role in his child’s divorce as settlor of various family trusts.
  • Advising executors in connection with a challenge to the validity of the deceased’s will on the grounds of undue influence.
  • Advising in connection with a professional negligence claim for the costs of an application to the Royal Court in Jersey to rectify a trust which was created as a result of negligent advice.
  • Ongoing advice to trustees of a life interest trust in relation to their distribution policy to ensure balance is maintained between the income and capital beneficiaries.
